Offer Agreement

 

General Provisions

1.1. This offer is an official proposal by FOP Sakhman Vasyl Stepanovich (hereinafter referred to as the "Seller") to conclude a Distance Sale Agreement for goods through the Online Store, hereinafter referred to as the "Agreement", and publishes the Public Offer on the official website of the Seller at https://granitlegion.com (hereinafter referred to as the "Website").

1.2. The moment of full and unconditional acceptance of the Seller's offer by the Buyer (acceptance) to conclude an electronic sale agreement is considered the fact of payment by the Buyer for the order under the terms of this Agreement, within the deadlines and at the prices indicated on the Seller's Website.

Terms and Definitions

2.1. In this offer, unless the context requires otherwise, the following terms shall have the meanings indicated below:

  • Goods – models, accessories, components, and related items;
  • Online Store – in accordance with the Law of Ukraine "On Electronic Commerce", a means for offering or selling goods, works, or services through electronic transactions;
  • Seller – the company selling the goods presented on the Website;
  • Buyer – an individual who concludes an Agreement with the Seller under the terms set forth herein;
  • Order – selection of specific items from the list of goods specified by the Buyer when placing an order and making payment.

 

Subject of the Agreement

3.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement. This Agreement governs the sale of goods in the Online Store, including:

  • voluntary selection of goods by the Buyer in the Online Store;
  • independent placement of an order by the Buyer in the Online Store;
  • payment by the Buyer for an order placed in the Online Store;
  • processing and delivery of the order to the Buyer under the terms of this Agreement.

 

Order Placement Procedure

4.1. The Buyer has the right to place an order for any available product presented on the Website.

4.2. Each item may be ordered in any quantity.

4.3. If the product is out of stock, the company Manager shall notify the Buyer (by phone or email).

4.4. If the product is unavailable, the Buyer has the right to replace it with a product of a similar model, refuse the product, or cancel the order.

Payment Terms

5.1. Payment by bank card through the LiqPay payment system.

Delivery Terms

6.1. Delivery of goods purchased in the Online Store is carried out to the warehouses of transport companies, where orders are handed over to the Buyer.

6.2. Along with the order, the Buyer receives documents in accordance with the legislation of Ukraine.

Rights and Obligations of the Parties

7.1. The Seller has the right to unilaterally suspend the provision of services under this Agreement in case of violation of its terms by the Buyer.

7.2. The Buyer is obliged to timely pay for and receive the order under the terms of this Agreement.

7.3. The Buyer has the right to:

  • place an order in the Online Store;
  • conclude an electronic agreement;
  • require the Seller to fulfill the terms of this Agreement.

 

Liability of the Parties

8.1. The Parties are liable for non-performance or improper performance of the terms of this Agreement in accordance with this Agreement and the current legislation of Ukraine.

8.2. The Seller is not responsible for:

  • changes in the appearance of the Goods made by the manufacturer;
  • minor differences in color that may differ from the original due to monitor color variations;
  • the content and accuracy of information provided by the Buyer when placing the order;
  • delays or interruptions in services (processing and delivery) caused by circumstances beyond the Seller’s control;
  • illegal actions committed by the Buyer using Internet access;
  • sharing of network identifiers (IP, MAC addresses, login, password) by the Buyer with third parties.

 

8.3. The Buyer, using the provided Internet access, bears full responsibility for damage caused by their actions to individuals, property, legal entities, the state, or ethical principles.

8.4. In case of force majeure, the parties are released from fulfilling the terms of this Agreement. Force majeure includes extraordinary and unforeseen events that prevent or objectively hinder the execution of this Agreement, which the Parties could not have predicted or prevented by reasonable means.

8.5. The Parties shall make every effort to resolve disputes exclusively through negotiations.

Other Terms

9.1. The Online Store reserves the right to unilaterally amend this Agreement, provided it is published on the Website https://granitlegion.com.

9.2. The Online Store is created to facilitate the remote sale of goods via the Internet.

9.3. The Buyer is responsible for the accuracy of information provided when placing an order. By accepting the order and making payment, the Buyer gives unconditional consent to the Seller to collect, process, store, and use their personal data in accordance with the Law of Ukraine "On Personal Data Protection".

9.4. Payment by the Buyer for an order placed in the Online Store constitutes full acceptance of the terms of the sale agreement (public offer).

9.5. The effective date of the electronic transaction is the date of acceptance of the terms in accordance with Article 11 of the Law of Ukraine "On Electronic Commerce".

9.6. Using the Online Store for browsing products and placing orders is free of charge.

9.7. Information provided by the Buyer is confidential. The Online Store uses this information solely for processing orders, sending notifications, delivering goods, and financial settlements.

Return of Goods in Proper Condition

10.1. Returns are carried out in accordance with the current legislation of Ukraine.

10.2. Returns are at the Buyer’s expense.

10.3. When returning goods in proper condition, the Online Store refunds the amount paid minus delivery costs.

Term of the Agreement

11.1. The electronic agreement is considered concluded upon receipt of the acceptance by the party making the offer, in accordance with Part 6 of Article 11 of the Law of Ukraine "On Electronic Commerce".

11.2. This Agreement may be terminated by mutual consent before the actual delivery of the goods, with a refund of the payment.

11.3. The Parties may terminate the Agreement unilaterally in case of non-fulfillment of its terms by either party and in cases provided by the current legislation of Ukraine.
